General terms and conditions

1. Scope of Application, Scope of Services:
Your ski guide provides services based solely on the following terms and conditions (T&Cs). These apply to all legal relationships between the ski guide and guests, even if not expressly referred to.

2. Conclusion of Contract:
The ski guide contract between the guest and the ski guide comes into effect when agreement on essential contract elements is reached. Booking can be made in writing or verbally. Telephonic bookings are legally binding. In the case of multiple participants, the individual registering is liable for payment.

3. Change of Guest:
The guest has the right to transfer the contract to another person who meets all conditions for participation. Both the transferrer and transferee are jointly and severally liable for the unpaid fee and any additional costs incurred.

4. Minimum Number of Participants:
Events can only be conducted if the minimum number of participants is reached. If not, the ski guide has the right to withdraw up to 7 days before the event.

5. Insurance:
The ski guide possesses mandatory liability insurance. However, guests are responsible for obtaining personal insurance related to planned tours, particularly accident insurance, as high costs might arise from helicopter or mountain rescue operations not covered by regular social insurance.

6. Warranty:
Guests have a claim in the event of non-performance or deficient performance.

7. Compensation:
Liability of the ski guides Zillertal is limited. Guests participate in tours at their own risk.

8. Termination of Contract by the Guest:
The guest has the right to cancel the contract at any time in writing. Cancellation costs depend on the timeframe before the tour start date.

9. Termination by the Ski Guide Before Departure:
The ski guide can cancel the contract due to unforeseen, unavoidable circumstances. The guest is liable for incurred expenses.

10. Termination by the Ski Guides Zillertal After the Start of the Tour:
The ski guide can terminate the contract if a guest disrupts or endangers the tour due to gross negligence or misconduct.

11. Contract Amendments:
The ski guide reserves the right to change the fee due to circumstances outside their control. Program changes due to weather or other unforeseen events are also possible.

12. Disclosure to Third Parties:
Information about guests is not disclosed to third parties without guest consent, except in urgent cases.

13. Data Protection and Advertising:
Personal data is processed for contractual purposes. Photos and videos taken during tours might be used for advertising by the ski guide.

14. Final Provisions:
Austrian law applies. If any provision of the contract, including these T&Cs, is or becomes invalid, the validity of the remaining provisions shall not be affected.
